QUESTION

How do trademark subsidies work? Who can apply for them?

ANSWER:

The SME Fund offers financial support to small and medium-sized enterprises (SMEs) based in the European Union. You can determine if you belong among small or medium-sized enterprises according to the data in the following table:

Enterprise Category Number of Employees (Main Criterion) Annual Turnover (Secondary Criterion) Annual Balance Sheet Total (Secondary Criterion)
Small enterprise 10 to 49 $\le$ €10,000,000 $\le$ €10,000,000
Medium enterprise 50 to 249 $\le$ €50,000,000 $\le$ €43,000,000

The application can be submitted by the business owner, an employee, or an authorized external representative acting on their behalf. Grants are awarded in the form of vouchers, which the recipient can use to claim a refund. The refund is always transferred directly to the SME’s bank account.

The SME Fund offers 4 different vouchers:

  • Voucher No. 1 – Intellectual Property scanning services (IP Scan) – up to €1,500.

  • Voucher No. 2 – Trademark and design applications – up to €700.

  • Voucher No. 3 – Patent applications – up to €2,500.

  • Voucher No. 4 – Plant variety rights applications – up to €2,500.

EUIPO (European Union Intellectual Property Office) is opening the SME Fund again in 2025, and it is possible to apply for a grant to protect one of the industrial rights from February 3, 2025.

Detailed information on how the fund works can be found on the official website of the Industrial Property Office.

QUESTION

Greetings, if I want to register a trademark in the EU that I already have registered in Slovakia, what are the fees there? I am interested in 5 classes. Thank you very much.

ANSWER:

Hello, according to the available information provided by the relevant office, the fee is as follows:

  1. class – €850

  2. class – €50 every additional class from the 3rd class – €150 per class

In your case, this means that for 5 classes, you will pay a fee of €1,350 (€850 + €50 + €150 + €150 + €150).
