Czech birth certificate for a child born abroad

If your child was born abroad, they will not automatically receive a Czech birth certificate or Czech passport. In order to register the birth of your child in the Czech registry, you must complete a special procedure with the relevant authorities. This process can be time-consuming and administratively demanding for parents living abroad.

According to Section 4 of Act No. 186/2013 Coll. on Czech citizenship, “A child acquires Czech citizenship by birth if at least one of the parents is a Czech citizen on the day of the child’s birth.” If at least one of the parents was a Czech citizen at the time of your child’s birth, your child born abroad also acquired Czech citizenship.

In order for Czech documents to be issued to the child, its birth must be registered in a special register in Brno. However, before the birth can be registered, the child’s Czech citizenship must be verified. The process therefore consists of two steps:

Entry in a special register

An application for entry in the special register is submitted to any registry office or regional office where the citizen took the oath of citizenship or made a declaration of acquisition of Czech citizenship. Abroad, the application can be submitted to a diplomatic mission of the Czech Republic. The application can also be submitted directly to the special registry office.

The following persons may request the registration of a citizen’s birth in a special register:

  • the natural person to whom the registration relates, or
  • members of their family (i.e. spouse, partner, parents, children, siblings, grandparents, grandchildren, great-grandchildren) or authorized representatives of these persons.

According to Section 43 of Act No. 301/2000 Coll. on registers, names and surnames and on amendments to certain related acts, the following applies

“(1) An application for entry in a special register shall be submitted to a diplomatic mission of the Czech Republic, any registry office, or a regional authority before which a citizen has taken the oath of citizenship or made a declaration of acquisition of Czech citizenship, and shall be accompanied by

  • a foreign registry document relating to the registry event to be entered in the special registry; if the foreign registry document cannot be submitted due to a serious obstacle, the entry may also be made on the basis of other public documents,
  • proof of Czech citizenship of the person to whom the entry relates,
  • other documents necessary to verify the accuracy of the registry facts entered in the registry book, if they cannot be proven by the documents referred to in points a) or b).

(2) In the case of registering the birth of a child who is younger than 1 year old on the date of submitting the application for registration in the special register, instead of proof of the child’s Czech citizenship, the following may be submitted for a child born

  • during marriage, proof of the Czech citizenship of the child’s mother or father on the date of the child’s birth, or
  • outside of marriage, a document proving the Czech citizenship of the child’s mother on the date of the child’s birth.”

Certificate of Czech citizenship

To register a birth and issue a certificate of Czech citizenship, the following documents must be submitted:

  • foreign birth certificate (if the child was born in Slovakia, a Slovak birth certificate is submitted, which does not require any verification or translation. If the child was born in another country, it is necessary to submit a foreign birth certificate from that country, which must be accompanied by an official translation into Czech and the prescribed verification);
  • a completed questionnaire to determine Czech citizenship and issue a certificate of Czech citizenship;
  • birth certificates of both parents;
  • for children born during marriage, the Czech marriage certificate of the parents; if the applicant only has a foreign marriage certificate, they must also submit an application for registration of marriage;
  • for children born outside of marriage, it is necessary to prove the marital status of the mother at the time of the child’s birth in order to determine parentage in accordance with the relevant provisions of the Civil Code, and to submit:
    • if the child’s mother is divorced, the divorce decree with a certificate of validity,
    • if the child’s mother is a widow, the death certificate of her husband or a court decree declaring her husband dead with a certificate of validity,
    • if the mother is single or the parents are not married, the parents shall submit a record of the determination of paternity by joint declaration of the parents, which also includes an agreement on the child’s surname (in Slovakia, this is the document “record of the determination of paternity”);
  • for adopted children, a valid court ruling on adoption, the adoptive parents’ marriage certificate and, if available, the marriage certificate or other documents of the biological parents;
  • if applicable, a request to register the surname of a minor girl in the masculine form: the surnames of women who are citizens of the Czech Republic are formed in accordance with the rules of Czech spelling, usually with the ending -ová. At the request of the child’s legal representative, the surname may be registered in the masculine form. In this case, the parents must appear in person and sign the application together in front of a consular department employee;
  • a valid Czech passport or Czech identity card of the parent requesting the registration of the child’s birth;
  • if a parent who is a Czech citizen has acquired foreign citizenship, it is necessary to submit a document proving the date and manner of acquisition of that citizenship.

Application forms for entry in the special register are available at any registry office or, abroad, at a diplomatic mission of the Czech Republic.

No administrative fee is charged for registration in the registry books kept by the special registry or for the issuance of an original registry document (birth, marriage, or death certificate, or certificate of registered partnership).

Registry entries are made no later than 30 days after receipt of all necessary documents, or no later than 60 days in particularly complex cases.
