If you were divorced in Canada, your Canadian divorce decree is not automatically recognized in the Slovak Republic. To be legally considered single (or divorced) by Slovak authorities and, for example, be eligible to remarry, you must undergo the process of recognition of a foreign judicial decision.

Since Canada is not a member of the European Union, the process is not governed by EU regulations, but rather by the Slovak Act on Private International Law and Procedure.

Where is the application submitted?

Important Notice

A key piece of information, also emphasized by the Embassy of the Slovak Republic in Ottawa, is that applications for the recognition of a divorce are not submitted through the embassy or consulate. The Slovak Embassy does not act in this process.

The exclusive jurisdiction to recognize foreign judgments in matrimonial matters lies with the Regional Court in Bratislava. This court issues a judgment of recognition, based on which the Special Registry (Osobitná matrika) in Bratislava subsequently records the entry into the Slovak registry of vital records.

What will you need for the recognition? (Required Documents)

In order for the Regional Court in Bratislava to initiate proceedings, you must file a motion (petition) with the court and submit a complete package of documents, specifically:

  • Original or certified copy of the divorce decree: This must be a final decision (e.g., Divorce Judgment or Certificate of Divorce).
  • Confirmation of legal force: The document must contain a clause or confirmation stating that the judgment is final and no longer subject to appeal.
  • Higher certification of the document (Apostille): Since January 11, 2024, the process has been simplified. Canada has acceded to the Hague Convention, meaning complex superlegalization is no longer required. The Canadian judgment must be bearing an Apostille, issued by the relevant Canadian authority (Global Affairs Canada or provincial authorities).
  • Certified (sworn) translation: The entire judgment, including the Apostille clause, must be translated into the Slovak language. Please note that the translation must be performed by a Slovak certified translator registered with the Ministry of Justice of the Slovak Republic. We are happy to assist you with these translations.
  • Motion for the recognition of a foreign judicial decision: A formal application addressed to the Regional Court in Bratislava, which must contain all legally required elements.

How does the process work? (Step-by-Step)

If you plan to have your Canadian divorce recognized in Slovakia, do not hesitate to contact us at recepcia@akmv.sk. We will send you a questionnaire to collect the necessary data along with a checklist of required documents.

  • Step 1: Obtaining documents in Canada: You must have the original divorce decree along with a certificate of legal force (a document stating the exact date the divorce became final and effective). If you do not have these documents, they must be requested from the specific Canadian court that granted the divorce.
  • Step 2: Obtaining the Apostille: Your documents must be authenticated with an apostille in Canada. Without this certification, the Slovak court will not accept the documents. We can arrange the Apostille for you through our partner at https://www.legalizacnecentrum.sk.
  • Step 3: Certified translation and court filing: Once the documents arrive in Slovakia, they must be translated, and a formal motion must be drafted for the Regional Court in Bratislava. A court fee is required for the filing.
  • Step 4: Judgment of recognition and registry entry: After the Regional Court in Bratislava issues the judgment recognizing the Canadian divorce (this process typically takes about 3–4 months, depending on the case), the judgment becomes final 15 days after delivery. With this document, we will also apply for the entry into the Special Registry on your behalf. This finalizes the recognition process, and you will receive a Slovak marriage certificate with a divorce remark.
