Divorce proceedings in Switzerland represent a complex process for many Slovak nationals residing abroad. However, the procedure does not terminate upon the Swiss judgment attaining final and binding effect (res judicata). In order for an individual to be considered divorced under Slovak law—which is a prerequisite, for instance, for contracting a new marriage or for changing one’s surname in official identity documents—this judgment must be formally recognized within the territory of the Slovak Republic.

Why is the Recognition of the Judgment Required in Slovakia?
As Switzerland is not a Member State of the European Union, simplified European regulations governing the automatic recognition of judgments do not apply to it. Pursuant to Slovak law, if a judgment was issued by a non-EU third country (or by a court of an EU Member State prior to May 1, 2004), it is mandatory that such judgment be granted formal recognition by the Regional Court in Bratislava.
Tip
If you are not in contact with your ex-spouse, this does not constitute an obstacle. In such an event, we will draft an affidavit on your behalf attesting to the fact that you are no longer in contact with the other party.
What Documents Will You Require?
The court requires strict adherence to formal prerequisites. The motion, which we will draft on your behalf, must be accompanied primarily by the following documentary evidence:
- Divorce Judgment: Must be an original document bearing the official seal and signature of the judge (not a copy). An Apostille / superlegalization is also required. As this is a Swiss document, it must be endorsed with an Apostille certificate confirming the authenticity of the public document for use abroad.
- Certificate of Finality (Res Judicata Clause): Either affixed directly to the judgment (as a stamp) or issued as a standalone document specifying the exact date on which the divorce entered into legal force.
- Official Translation: The documents must be officially translated into the Slovak language in hard copy by a sworn translator enrolled in the Register of Translators kept by the Ministry of Justice of the Slovak Republic. Should you require it, AKMV can arrange this translation for you.
- Identity Documents of the Spouses (copies)
- Affidavit (regarding decisions by another court or the residence/whereabouts of the other ex-spouse)
- Power of Attorney: We will draft the Power of Attorney for legal representation in the proceedings on your behalf.
Interesting fact
In certain jurisdictions, courts issue two distinct decrees in divorce proceedings (e.g., the UK), where an interim decree is rendered initially, followed subsequently by a final decree.
Court Fee and Statutory Time Limits
A court fee of EUR 50 is payable to the court for the recognition of a divorce decree.
Based on our professional experience, the Regional Court issues the judgment on recognition within approximately 3 to 4 months.

Interesting fact
While the Regional Court does not require the submission of a Slovak marriage certificate (or the recognition of a foreign marriage certificate) for issuing a judgment on the recognition of a divorce in the Slovak Republic, based on our experience, the Civil Registry Office will not issue a marriage certificate featuring a divorce endorsement without it. Therefore, we are also able to assist you with the registration of your marriage in the Slovak Republic.
