I have obtained foreign citizenship and want to regain Slovak citizenship

Hello, in 2005 I renounced my Slovak citizenship in order to obtain German citizenship. Can I get it back?

ANSWER:

Yes, former citizens of the Slovak Republic have the option to apply for the reacquisition of Slovak citizenship. However, the condition is that applicants must have residence granted in the territory of the Slovak Republic. In the case of a former citizen of the Slovak Republic, continuous permanent residence in the territory of the Slovak Republic is not required. For former citizens who acquired citizenship of one of the EU member states, it is sufficient to have registered residence.

Hello, In 2014, I obtained Canadian citizenship, and I’ve been living here since around 2005. However, I would like to move back to Slovakia, but I recently read that I may have lost my Slovak citizenship. Is that true? Can I get it back?

ANSWER:

Dear Sir/Madam,

Thank you for your message.

At the time when you acquired Canadian citizenship, the Slovak law in force stated that “Slovak citizenship may be lost either by release from the state bond of the Slovak Republic upon one’s own request or by acquiring foreign citizenship based on an explicit expression of will.”

According to Section 9, paragraph 16 of the Citizenship Act (in force in 2014), “A citizen of the Slovak Republic loses Slovak citizenship on the day when, by an explicit expression of will—such as an application, declaration, or other act aimed at acquiring foreign citizenship—they voluntarily acquire foreign citizenship.”

Based on the above, it can be concluded that you have likely lost your Slovak citizenship. This fact should also have been reported to the Ministry.

The way to resolve your situation is to submit a retroactive notification of the loss of Slovak citizenship and then apply for the granting of Slovak citizenship again.

According to Section 7, paragraph 7 of the Citizenship Act, “Without fulfilling the condition under paragraph 1(a), Slovak citizenship shall be granted to an applicant who lost Slovak citizenship by acquiring foreign citizenship between 17 July 2010 and 31 March 2022, provided that the applicant acquired the foreign citizenship of a country in which, at the time of acquisition, they had an authorized, registered, or otherwise recorded residence for at least five years and submits documentary evidence thereof in written form; the condition of residence shall be deemed fulfilled if the applicant actually resided in the foreign country during that period.”

To reacquire Slovak citizenship, you must prove that you have been residing in Canada since 2009.
