QUESTION
Hello, I have a question regarding the granting of state citizenship for a citizen of Ukraine. Is the given citizen of Ukraine allowed to apply for Slovak citizenship if they have lived and worked in Slovakia for less than five years? I mean after entering into a marriage, if that has any influence.
ANSWER:
The options for granting state citizenship are regulated by Act No. 40/1993 Coll. on State Citizenship of the Slovak Republic.
An applicant who has entered into marriage with a citizen of the Slovak Republic and has a permitted residence in the territory of the Slovak Republic may submit an application for the granting of state citizenship no earlier than after the expiration of five (5) years immediately preceding the submission of the application. The condition is that at the time of submitting the application, the marriage still lasts and the spouses live in a common household in the territory of the Slovak Republic.
If it were not for the spouse of a Slovak Republic citizen, the law requires a continuous permanent residence of at least eight (8) years immediately before submitting the application, or a continuous residence of at least ten (10) years if the applicant has already been granted permanent residence at the time of submitting the application.
It does not follow from your question that any of the exceptions according to Section 7, subsections 2 to 6 of the Act on State Citizenship could apply to the applicant, where it is possible to submit an application even after a residence shorter than five years in the territory of the Slovak Republic (e.g., if it is an applicant who was issued a certificate proving the status of a Slovak living abroad, an applicant who significantly contributed to the benefit of the Slovak Republic, etc.).
