Permission for transportation – using the same vehicles by multiple carriers

Please provide information on the situation when a lease agreement for vehicles, which the applicant does not own but only leases, is attached to an application for freight transport. How should the applicant (LLC) proceed – what is the deadline for transferring the truck registration to the LLC? If the owner of the truck (CEO of the LLC as a private entrepreneur) owned the vehicles and then leased them to the LLC, until when can this owner continue performing transport activities? Or can both the owner and the lessee operate transport using the same truck, as both have transport permits? Thank you for the information.

ANSWER:

Vehicles are not directly listed in the permit or in the Community licenses. Vehicle data is only used as a basis for determining the number of vehicles and the financial reliability of the business.

The company can own or lease the vehicles (according to § 32 of Act No. 56/2012 Coll. on road transport). One vehicle can also be used by two carriers if both have a road transport operator permit issued.
