Consent of the Biological Father
First and foremost, it will be examined whether the child’s biological father gives consent to the adoption. In cases where the father shows no interest in the child, does not provide child support, and does not contact him, it is possible that the court will not require his consent. However, the court will decide on this based on an assessment of all circumstances.
Filing a Petition with the Court
The petition for adoption must be filed with the competent municipal court (mestský súd) at the child’s place of residence. This petition must clearly state who is applying to adopt the child and what the reasons are. The petition must be signed and contain data about the adopting partner, the mother, and the child.
Documents Accompanying the Petition
Several documents need to be attached to the petition, including:
