It often happens that the Land Registry suspends proceedings and invites the parties to submit an addendum to the (purchase / donation / exchange or otherwise named) contract. In some cases, it also requires an addendum to the application for registration.

According to the law, “If the contract contains clerical, calculation, or other obvious errors after the application for registration has been filed, the parties to the proceedings may make corrections only by means of an addendum to the contract.” It is therefore no longer possible — as it was in the past — to appear in person at the Land Registry and add missing details or correct errors directly in the contract.

Most Common Errors

Errors in the Contract / Agreement

One of the most frequent issues we encounter is that the contract or agreement serving as the legal basis for the proposed change in the Land Registry does not meet statutory requirements.
Such a document must include precise identification of:

  • the property by cadastral territory,
  • the land by parcel number registered in the descriptive information file,
  • whether the land is recorded as a “C” register or “E” register parcel,
  • the type of land and its area,
  • the building’s registration number and parcel number of the land on which the building stands,
  • the apartment or non-residential unit number, floor number, entrance number, and
  • co-ownership share in the common parts and facilities of the building and the land (or adjoining land),
  • if the property is co-owned, the share must be expressed as a fraction of the whole.

Errors in the Application for Registration

An application to initiate cadastral proceedings must include:

  • a) Identification details of the applicant: For individuals: full name (including maiden name), date of birth, national ID number (or alternative identifier for foreigners), permanent address, contact address (if different), and nationality. For legal entities: business name, company ID number, registered office, and contact address (if different).
  • b) The name of the District Office to which the application is addressed.
  • c) Specification of the subject of the application.
  • d) Indication of the legal act on which the transfer, change, or termination of property rights is based.
  • e) Description of the property according to § 42(2)(c).
  • f) Indication of the co-ownership share, expressed as a fraction.
  • g) Number of the officially verified geometric plan, if the land is being divided, merged, or an easement is being created on part of a parcel.
  • h) Information on the place and date of publication if it is a contract required by law to be published.
  • i) List of attachments.
  • j) Request to receive notification of the registration or decision via electronic communication (email or data box).
  • k) Request for accelerated proceedings, if applicable.

If the application is submitted in paper form, all attachments must be presented either in original form or as officially certified copies.
