Acquisition of Real Estate by Foreign Nationals
QUESTION
I am a Slovak citizen residing in Wales (UK) for over 5 years and I am a holder of a Permanent Resident card. I am seeking legal advice regarding my application for British citizenship; however, I own a residential apartment in Slovakia where I do not maintain a permanent residence. Are there any legal solutions available? Am I entitled to retain ownership of the apartment notwithstanding the loss of my Slovak citizenship?
ANSWER:
The loss of Slovak citizenship shall have no legal effect on the ownership title to your apartment. Accordingly, you shall be entitled to retain ownership of the apartment notwithstanding the loss of Slovak citizenship.
Upon the acquisition of United Kingdom citizenship, the loss of Slovak citizenship would occur ex lege (by operation of law). You would be subject to a statutory obligation to submit a notice of loss of Slovak citizenship. Following the loss of citizenship, however, it is possible to apply for the restoration of citizenship, should you wish to do so.
