Appeal against a divorce judgment
QUESTION
I would like to ask if I have the right to file an appeal against a divorce judgment. My wife and I were divorced, but I signed a waiver of my right to appeal because I was being mentally blackmailed by her and I didn’t want to lose my children because of it.
ANSWER:
Hello, if you have waived your right to file an appeal, the decision has become legally binding (final) with respect to you, and an appeal is no longer admissible.
We assume that you were instructed by the court on the consequences of waiving the right to appeal. If the judgment has already been delivered to you, we draw your attention to the section of the judgment labeled “Poučenie” (Instructions/Notice), where you will find information regarding the admissibility of an appeal.
