Cancellation of permanent residence from Slovakia
QUESTION
Hello. I would like to cancel my permanent residence in Slovakia, as I live abroad, but I do not want to lose my Slovak ID card. Is it possible to keep it?
ANSWER:
According to Act No. 224/2006 Coll. on Identity Cards and on amendments and supplements to certain acts, the identity card of a citizen who has terminated their permanent residence in the territory of the Slovak Republic is considered invalid. A citizen is obliged to surrender an invalid identity card to a district directorate of the Police Force or to a diplomatic mission of the Slovak Republic abroad.
At the same time, according to Act No. 253/1998 Coll. on Reporting the Residence of Citizens of the Slovak Republic and the Register of Inhabitants of the Slovak Republic, a citizen may have only one permanent residence at any given time.
A citizen preparing to travel abroad with the aim of living abroad permanently is obliged, before departure, to report the termination of permanent residence to the reporting office that maintains the records of their permanent residence; in the report, they shall state the country and place of residence where they intend to travel, and the day of the start of the residence abroad, which is also the day of the termination of permanent residence.
Based on the above, in the case of residence abroad, it is necessary to check out of permanent residence in the territory of the Slovak Republic and surrender the identity card. The law does not establish any exceptions where it would be possible to keep the identity card.
