Enclosures to the Application for Slovak Citizenship and Processing Period

QUESTION

Which documents and certificates are required to acquire citizenship? And what is the duration of the citizenship acquisition process?

ANSWER:

For the granting of state citizenship, Act No. 40/1993 Coll. establishes the following conditions:

  • Continuous residence in the territory of the Slovak Republic (continuous permanent residence for at least 8 years immediately preceding the submission of the application, or 5 years in the case of marriage to a Slovak citizen, provided the marriage continues and the spouses live in a common household in the Slovak Republic);

  • Integrity (clean criminal record);

  • The applicant has not been sentenced to expulsion, is not subject to criminal prosecution, extradition proceedings, proceedings on the execution of a European arrest warrant, administrative expulsion proceedings, or proceedings for the withdrawal of asylum;

  • Demonstrated command of the Slovak language in both oral and written form and general knowledge of the Slovak Republic;

  • Fulfillment of obligations arising from the legal regulations governing the residence of foreigners in the territory of the Slovak Republic.

The following documents will be required in particular for the citizenship application:

  • Forms – application for state citizenship and the applicant’s questionnaire (attached).

  • Brief Curriculum Vitae – hand-written.

  • Original identification document – please send a copy of the passport; the original must be presented upon submission.

  • Birth certificate – this must be apostilled and translated by a Slovak sworn translator.

  • Marriage certificate – if the marriage certificate is foreign, it must be apostilled and translated. If issued in the Slovak Republic or by the Special Registry Office, a copy is sufficient, provided the original is presented for inspection upon submission.

  • Original proof of residence in the territory of the Slovak Republic – please send a copy of the residence card; the original must be presented upon submission.

  • Criminal record extract not older than 6 months as of the date of submission from the applicant’s country of nationality. Likewise, a criminal record extract must be submitted from all countries where the applicant held a residence permit in the last 15 years, regardless of the duration of stay. Extracts must be apostilled/superlegalized and translated by a Slovak sworn translator. A Slovak criminal record extract is not required.

  • Confirmation from the tax office, customs office, and municipality regarding the payment of taxes and fees. Also from the municipal authority regarding real estate tax.

  • The same confirmation must be submitted for a company as a legal entity if the applicant holds a position therein.

  • Extract from the Commercial Register / Trade Register if the applicant is engaged in business.

  • Employer’s confirmation of employment and a copy of the employment contract if the applicant is employed – it is also recommended to request a document certifying that social security contributions were duly paid on behalf of the applicant.

  • Employer’s confirmation of the payment of income tax and payment of premiums for public health insurance, social insurance, and old-age pension savings.

  • Original confirmation from the health insurance company regarding the payment of public health insurance premiums and the duration of the insurance relationship. Confirmations from all insurance companies where the applicant was insured must be submitted.

  • If the applicant is also in an employment relationship as a managing director in a company, they shall submit a copy of the employment contract and the employer’s confirmation of the payment of income tax and insurance premiums. Alternatively, another contract pertaining to the position of managing director may be submitted along with confirmation that all contributions have been paid.

  • Where applicable: confirmation of studies, confirmation of pension receipt, confirmation of registration as a jobseeker, or confirmation of a source of income sufficient to finance the stay of the applicant and their close persons in the Slovak Republic if voluntarily unemployed.

The application is submitted to the District Office at the seat of the Region. Although submission is possible during office hours, it is recommended to coordinate the submission date in advance with the staff of the State Citizenship Department.

The Slovak legal order does not require the termination of the applicant’s foreign citizenship prior to the acquisition of Slovak citizenship. According to information from the practice of the Ministry of Interior of the Slovak Republic, the Czech legal order allows for the retention of Czech citizenship even upon the acquisition of another state’s citizenship.

The Act on State Citizenship imposes a 24-month deadline on the Ministry of Interior to decide on the application for state citizenship. If statements from other state authorities are required for the issuance of the decision, the process may be extended by the time necessary to provide such statements.
