Extension of the license for transport over 3.5 tons to additional vehicles

QUESTION

We are a transport company holding a Community license for international road transport. However, our fleet (all vehicles over 3.5 tons) is expanding, and therefore we need to extend our license to include additional vehicles. Due to our workload, I kindly ask for information on what documents are required to submit for the extension of our operations in freight transport (both domestic and international) to include more vehicles. The company already has the permit but wishes to extend it to cover additional trucks.

ANSWER:

To request a change (increase in the number of motor vehicles) in the permit for performing the profession of a road transport operator, it is necessary to submit an application to the transport authority.

In the form, you should mark “change of permit” and under the field “Other,” specify the requested change – increase in the number of motor vehicles by ….

You must attach proof of meeting the financial reliability condition for the increased number of motor vehicles – to meet the financial reliability condition, the carrier must demonstrate financial reliability in the amount of €9,000 for the first vehicle and €5,000 for each additional motor vehicle.

The methods of proving financial reliability are set out in § 6(5) of Act No. 56/2012 Coll. on Road Transport, as amended, in § 2 of Decree No. 124/2012 Coll., implementing the said Act, and in Article 7 of EU Regulation No. 1071/2009 of 21 October 2009.

To fulfill the financial reliability condition, it is also possible to accept (according to Article 7(2) of Regulation (EC) No. 1071/2009 of the European Parliament and of the Council) proof of financial reliability by liability insurance for damage caused in the performance of the road transport operator’s profession with an insured amount adequate to the total number of motor vehicles. If the carrier intends to perform international transport, the territorial validity of the insurance must also cover foreign countries (at least EU states).

The administrative fee for changing the permit to perform the profession of road transport operator is €10, according to item 79(q) of Act No. 145/1995 Coll. on Administrative Fees, as amended. This fee can be paid via the kiosk installed at the client center when submitting the application (service code 831).

After the issuance and finalization of the decision on the change of the permit to perform the profession of road transport operator, the carrier can request the issuance of additional certified copies of the Community license for international road transport. The application form is also attached.

The administrative fee of €3 for issuing one certified copy of the Community license, according to item 79(i) of Act No. 145/1995 Coll. on Administrative Fees, as amended, can also be paid via the kiosk at the client center when submitting the application (service code 834). No other documents need to be submitted if they have not changed (for example, if there have been no personnel changes in the company, the transport manager has not changed, or the parking/garage location has not changed).
