Notarial deed on the narrowing of joint marital property (BSM)
QUESTION
I want to take out a loan, but the bank requires that my wife and I have narrowed community property (BSM) and that the loan is exclusively in my name. We married in Hungary, my wife is Hungarian, and our marriage is not recognized in Slovakia (not entered in the special registry). Will a Slovak bank accept a notarial deed (notárska zápisnica) executed in Slovakia under these circumstances?

We consulted the above question with our cooperating notary, and the following answer was provided:If the legal concept of community property of spouses (BSM) exists in Hungary, where the marriage was concluded, then a Slovak notary may draw up an agreement on the narrowing of BSM, based on which you would be the sole debtor.However, we strongly recommend consulting the specific bank in question to confirm whether they will accept such a notarial deed.
