Which Foreign Nationals Do Not Need a Visa for Slovakia? – Visa-Free Regime
QUESTION
Citizens of which countries do not need a visa to enter Slovakia?
ANSWER:
According to § 2(6) of Act No. 404/2011 Coll. on the Residence of Foreigners and on Amendments to Certain Acts (hereinafter the “AFR”), “A third-country national who is exempt from the visa requirement is a third-country national who is not subject to the visa obligation under a special regulation, who is lawfully present in the territory of the Slovak Republic on the basis of a valid residence permit issued under this Act or on the basis of a residence authorisation, or if so provided by an international treaty.”
The special regulation referred to is Council Regulation (EC) No 539/2001 of 15 March 2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders of the Member States and those whose nationals are exempt from that requirement (hereinafter the “Regulation”). The full text of the Regulation, also in Slovak, can be found here: EUR-Lex – Regulation 539/2001.
It should be noted, however, that the current list of countries to which a citizen of the Slovak Republic can travel without a visa and vice versa (the so-called mutual visa-free regime) is now somewhat broader and includes countries not listed in the original Regulation.
Citizens of countries not listed on the above-mentioned lists require a visa to enter the territory of the Slovak Republic.
