What is needed to obtain an AÜ-Erlaubnis?

For a Slovak temporary employment agency (ADZ) to obtain a permit for agency employment in Germany (Arbeitnehmerüberlassungserlaubnis / AÜ-Erlaubnis), the following documents will be required:

  • Founding document/articles of association
  • Extract from the company’s commercial register
  • Criminal records certificates
  • Police clearance from Germany
  • Proof of accident insurance
  • Confirmations from health insurance companies that there are no outstanding insurance debts
  • Bank statements from all business accounts (the account must have at least €10,000 available; if the agency has at least 5 employees being posted abroad, there must be at least €2,000 per employee)
  • Employee loan agreement (between the Slovak ADZ and employees) and the assignment contract with the user company to which the employees are provided (Arbeitsvertrag, Arbeitnehmerüberlassungsvertrag – prepared by a collaborating lawyer in Germany).
