Voluntary loss of Slovak state citizenship

Loss of Slovak state citizenship mostly occurs for legal reasons, which is for example also the voluntary acquisition of foreign state citizenship based on an explicit expression of will. The loss of Slovak state citizenship will not occur if a citizen of the Slovak Republic acquires foreign state citizenship:

  • of a spouse during the duration of the marriage
  • by birth
  • by adoption
  • during minority
  • of a state in which they had permitted, registered or evidenced residence for a period of at least 5 years (actual stay in this state is required).

After acquiring another citizenship, a Slovak citizen has the obligation to notify:

  • the acquisition of foreign state citizenship to the Ministry of Justice of the SR within 90 days of its acquisition, or
  • without delay the loss of state citizenship to the district office in the region’s seat, if they do not meet any of the exceptions listed above.

For notifications, it is necessary to attach a document on the acquisition of foreign state citizenship (naturalization certificate) and, in the case of retaining Slovak citizenship, also related documentary evidence proving specific facts, e.g., birth certificate, marriage certificate, decision on adoption, confirmation of the length of stay and documents proving real stay in the given state.

Release from state ties

It is mostly in the interest of persons that their Slovak citizenship is retained after acquiring another citizenship. In some cases, it is necessary for them to lose their Slovak citizenship. For example, if the legal regulation of the state whose citizenship they have acquired or are promised does not permit dual citizenship.

In the sense of Section 9, paragraph 2 of the Citizenship Act: “A person who proves that they have the state citizenship of another state, or a promise of its granting in the case of release from the state ties of the Slovak Republic, may be released from the state ties of the Slovak Republic.”

It is not possible to release a person from state ties:

  • against whom criminal prosecution is being conducted
  • who is in the execution of a sentence
  • who has not served a sentence imposed on them by the court
  • who has arrears at the tax or customs office, towards the social or health insurance company, and the municipalit

Submission of application

The application must be submitted in person at the district office in the regional seat according to the applicant’s residence / last residence, or abroad at a diplomatic mission or a consular office of the SR. The district office will decide on the application within 6 months of its delivery. Citizenship is lost at the moment of taking over the document on release from state ties.

The particulars of the application for release from state ties are:

  • name, surname and maiden name
  • personal identification number
  • date and place of birth of the applicant
  • address of residence
  • address of last residence on the territory of the Slovak Republic
  • reasons for the application
  • date and signature

Attachments to the application:

  • promise of granting state citizenship of another state or a document on its acquisition (naturalization certificate)
  • identity document
  • birth certificate
  • document on personal status (marriage certificate, judgment on divorce, death certificate of the spouse)
  • confirmation that the applicant has no registered arrears towards the municipality and the office of labour, social affairs and family

Statement of the District Office Bratislava on the necessary attachments

“1. In the case of a Slovak birth and marriage certificate, it is enough to submit copies and present the originals for inspection when submitting the application.

 

2. It is not necessary to submit either an Austrian or a Slovak criminal record extract.

 

3. Confirmations of non-existence of arrears from the tax office, customs office, Social Insurance Agency and health insurance companies will be secured by our office.

 

4. Confirmation from the labour office is not necessary.

 

5. Confirmation of the last residence on the territory of the SR is not necessary. If the client had her last residence in Bratislava, it is necessary to submit a confirmation of arrears from the relevant city district as well as from the magistrate’s office. If the applicant owns real estate outside the place of their last residence, a confirmation of arrears from the relevant municipality/city/city district is also required.”

Release from Slovak Citizenship for a Minor

A child under 14 years of age is included in the parent’s application and loses citizenship along with the parents. In such a case, the consent of the other parent with an officially verified signature is required. A person older than 14 applies for release from citizenship independently.

Tip

If, in connection with acquiring foreign citizenship, you apply for release from Slovak citizenship and do not lose Slovak citizenship for legal reasons (e.g., you acquired the same citizenship as your spouse), you are simultaneously obliged to file a notification of the acquisition of foreign citizenship.

Fees

The following fees are paid to the Offices:

  • a) Release from the State ties (citizenship) of the Slovak Republic for a person over 18 years of age €1,000
  • b) Release from the State ties (citizenship) of the Slovak Republic for a child
  • 1. up to 15 years of age €280
  • 2. from 15 years to 18 years of age €500
  • c) Release from the State ties (citizenship) of the Slovak Republic in connection with the granting of Czech Republic citizenship €30
  • Exemption
    Persons over 65 years of age and disability pensioners are exempt from the fees under letters a) and c) of this item.
  • Note
    The fee under this item shall be refunded if the release from the State ties (citizenship) of the Slovak Republic was not granted.
