Family reunification – temporary residence

QUESTION

My future husband would like to bring his 71-year-old mother from Iraq to Slovakia to live with us; I would very much like to help him with this and I want her to live with us as well so that she no longer has to be alone. I am asking you for more information; I would like to know what requirements we must meet. What documents will she need?

ANSWER:

Temporary residence for the purpose of family reunification would only come into consideration if the mother of a third-country national (hereinafter “foreigner”) residing in Slovakia (excluding residence for the purpose of study) were dependent on the care of her son and did not enjoy proper family support in the country she is coming from. This must be documented, for example, by a medical report proving the need for care by the son—the foreigner—for her person, as well as by an affidavit declaring that there is no other family member in the country she is coming from who could care for her. This follows from Section 27 of the Act on the Residence of Foreigners.

Just like the mother, the following other family members could also apply for residence for the same reason:

  • a spouse, if the spouses are at least 18 years old;

  • an unmarried child younger than 18 years of a third-country national and their spouse;

  • their unmarried child younger than 18 years;

  • the unmarried child of their spouse younger than 18 years;

  • their dependent unmarried child older than 18 years or the dependent unmarried child older than 18 years of their spouse who cannot care for themselves due to a long-term adverse health condition;

  • their parent or the parent of their spouse who is dependent on their care and does not enjoy proper family support in the country they are coming from.

The residence shall be granted until the expiry of the residence of the third-country national through whom the foreigner is exercising the right to family reunification, but for a maximum of five years.
