Section 19 of the Act on the Residence of Foreigners – Invitation

(1) An invitation is a supporting document used by a diplomatic mission to decide on an application for a Schengen visa. An invitation may be replaced by a hosting agreement pursuant to special regulations.

(2) Verification of an invitation may be requested by:

  • a) A citizen of the Slovak Republic or a foreign national with authorized residence in the territory of the Slovak Republic (this does not apply to third-country nationals staying under specific simplified regimes);

  • b) A legal person with its registered office in the territory of the Slovak Republic.

(3) The inviting person submits the application on an official form in person or may be represented by an authorized person. The application must include:

  • a) Data on the inviting person;

  • b) Personal data of the invited third-country national (name, DOB, nationality, address) and any children traveling with them;

  • c) The purpose of the invitation;

  • d) A commitment by the inviting person to cover all costs related to the stay and departure of the invited person.

(4) The inviting person must submit a proof of identity. The police department will issue a confirmation of receipt on the day the application is accepted.

(5) Documents attached to the application must not be older than 90 days (except for registry documents like birth/marriage certificates) and must prove:

  • a) The purpose of the invitation;

  • b) The financial ability to cover costs;

  • c) Provision of accommodation.

(6) Purpose of invitation may be proven by documents showing:

  • Family relationship, business authorization, professional/work relationships, organization of cultural/sporting/scientific events, study/education, or medical care.

(7) Financial ability is proven by a bank account statement for the last three months held in the name of the inviting person.

(8) Accommodation is proven by a confirmation from an accommodation facility, or a simplified affidavit (čestné vyhlásenie) from the property owner or authorized user.

(9) The required account balance must be a cumulative amount of twelve times the subsistence minimum plus the daily financial funds required for each day of the invited person’s stay (as set by general regulation).

(10) The police department (based on the inviter’s residence/office) verifies the invitation within 15 days after obtaining consent from the Ministry of Interior. A verified invitation is valid for 90 days from its issuance and covers a stay of up to 90 days.

(11) The Ministry of Interior shall not grant consent for verification if:

  • The person is undesirable; there is suspicion the purpose is not genuine; the person poses a threat to security, public order, or health; false data/documents were provided; there is suspicion of a marriage of convenience; or accommodation requirements are not met.

(12) If a verified invitation is lost or stolen, the police will declare it invalid upon notification and request for a new one.

(13) The General Regulation on Administrative Proceedings (Administrative Code) does not apply to decisions on the verification of invitations.

Greetings. I have a question: since I will provide travel insurance taken out in Slovakia and an affidavit of accommodation when applying for a tourist visa for a citizen of Egypt, is it really necessary to have such a large amount in the account? (12 times the subsistence minimum / day?)

ANSWER:

If you wish to apply for a Schengen tourist visa, as the inviting person, you must demonstrate the ability to cover all costs associated with the stay and departure of the third-country national you are inviting. You prove this fact with a confirmation of the balance on your bank account (not a confirmation of the foreigner’s account), which follows from Section 19(7) of Act No. 404/2011 Coll. on the Residence of Foreigners.

The balance on your account must be a total of:

  • Twelve times the subsistence minimum (the subsistence minimum for an adult natural person in 2019 was 205.07 EUR), which represents just under 2,500 EUR (a one-time amount, not per day) plus

  • Financial resources for each day of stay of the invited third-country national as specified in the generally binding legal regulation issued under Section 6(3). The amount of financial resources required to cover the costs associated with the stay of a third-country national in the territory of the Slovak Republic is determined in Article 6(4) of Regulation (EU) 2016/399 and is 56 EUR per day. This amount must be multiplied by the number of days for which the third-country national is invited to Slovakia.

The bank confirmation of the account balance must not be older than 90 days.

Hello, I would like to inquire about applying for a tourist visa for a citizen of Egypt. Could you please provide me with information on what documents are required for the application and where the application for a Schengen visa for the purpose of tourism can be submitted? Thank you.

The following documents are required to submit a Schengen visa application. This list includes both general requirements and specific conditions established by the Embassy in Egypt.

General Document Requirements:

  • Visa Application Form

  • Color Photograph (Size: 3 x 3.5 cm)

  • Valid Travel Document: Must be valid for at least 3 months longer than the expected validity of the visa and have at least two blank pages for the visa sticker.

  • Documents Proving the Purpose and Conditions of Stay: An invitation verified by the Foreign Police. The invitation letter should be issued in the Slovak language and notarized.

  • Proof of Accommodation: e.g., an affidavit of provision of accommodation with an officially (notary) verified signature.

  • Return Travel Ticket or Flight Reservation: Must not be an “open ticket.”

  • Documents on Financial Security: Proof of solvency in the amount of 56 EUR per day of stay (e.g., cash, traveler’s cheques, bank statements for the last 6–12 months).

  • Affidavit of Financial Security for the stay by the inviting person.

  • Bank Account Statement: Confirmed by the bank for the last 3 months.

  • International Travel Insurance: Minimum coverage of 30,000 EUR, covering the entire Schengen area and the entire period of stay. Insurance in the form of a sticker in the travel document (passport) is sufficient. This page does not need to be translated into Slovak if it is in English.

  • Cover Letter: Explaining the purpose of the stay and containing a detailed itinerary.

  • Additional Documents: Documents used for the verification of the invitation.

Specific Requirements for Citizens of Egypt:

  • Family Ties and Status: The “Kid Aely” document, which is also issued in English.

  • Travel History: A certificate from Mogamma for the last 7 years (for first-time travelers or in case of a lost passport). The document is issued in Arabic, but there is an on-site branch where a translation can be requested immediately.

  • Transport Documents: e.g., a detailed route and transport reservations.

  • Financial Documents: Original bank account statement for the last 6 months with an official stamp.

  • Employment or Business Documents: (Employees: employment certificate with position and salary details; Entrepreneurs: extract from the commercial register, tax card). The employer’s confirmation (“HR letter”) must bear the employer’s stamp.

  • Accommodation Documents: Confirmation of reservation, deposit, or other proof of accommodation.

  • Inviting Person’s Letter: Containing information about the applicant, the host, and the duration of the visit.

  • Host’s Documents: (Proof of residence, ID document, payslips, or other documents confirming income).

  • Sponsorship Letter and Health Insurance.

Granting of a Schengen Visa for the Purpose of Seasonal Employment (Section 16 of the Act on the Residence of Foreigners)

(3) A third-country national applying for a Schengen visa for the purpose of seasonal employment shall submit:

  • a) A written promise from an employer to hire the third-country national, containing the essentials of an employment contract, or the employment contract itself, as a document proving the purpose of the journey;

  • b) A work permit;

  • c) A document proving health insurance;

  • d) A document proving accommodation.

(4) Based on the documents in subsection 3, the diplomatic mission shall assess whether the third-country national will be reliant on the material need assistance system (social benefits) during their stay in the Slovak Republic.

(6) The diplomatic mission shall refuse the application for a Schengen visa for seasonal employment if:

  • a) The third-country national fails to submit the documents listed in subsection 3;

  • b) It finds that a document submitted with the application was obtained fraudulently, forged, or altered; or

  • c) Based on the assessment in subsection 4, it finds that the person will be reliant on the material need assistance system.

Appeal Against a Decision to Refuse, Annul, or Revoke a Schengen Visa

(10) A third-country national may appeal against a decision to refuse, annul, or revoke a Schengen visa. The appeal must be filed with the administrative authority that issued the decision within 15 days of the date of delivery; for family members of EU citizens, the limit is 30 days. If the refusal decision could not be delivered, the 15-day period begins 90 days after the visa application was submitted. If an annulment or revocation decision cannot be delivered within 90 days, it is delivered via a public notice on the official notice board for 15 days.

(11) An appeal against these decisions does not have a suspensive effect. The appeal must state who is filing it, why the decision is considered incorrect, and how it conflicts with legal regulations. The appeal and all documentation must be submitted in the state language (Slovak).

(12) The diplomatic mission may decide on the appeal itself if it grants it in full. Otherwise, it sends the appeal within five days to the Ministry of Foreign Affairs, which will decide. The Ministry assesses whether the reasons for the refusal comply with this Act. If the refusal was based on a negative opinion from the Ministry of Interior, the Ministry of Foreign Affairs may request a new opinion.

(13) A written decision on the appeal is generally delivered to the applicant within 60 days of filing. The decision is issued in the state language. If it cannot be delivered within 90 days, it is delivered via public notice on the embassy’s notice board for 15 days.

(14) General regulations on administrative proceedings (the Administrative Code) do not apply to these appeals, except in the case of a family member of an EU citizen.

(7) Decisions on refusal, annulment, or revocation are issued in the state language; at the request of the third-country national, they shall also be issued in a language determined by the diplomatic mission or police department.

(8) For a family member of an EU citizen, the application may only be refused if:

  • a) They fail to duly prove their identity or family relationship to the EU citizen; or

  • b) They pose a serious threat to state security, public order, or public health.

(9) A family member of an EU citizen’s visa may only be annulled or revoked for reasons stated in subsection 8(b).

Yes, Switzerland can be the country of first entry, as it is a member of the Schengen Area. Type C Schengen visas therefore also entitle him to enter this country.

If the application is submitted to the Slovak Embassy, the documents should be in the Slovak language. If you have documents in another language, we recommend contacting the relevant embassy to see if documents in that language will be accepted.

It is the same insurance, which must cover all expenses that could arise in connection with his return to his home country for medical reasons, urgent medical treatment, or emergency hospital treatment. The insurance must be valid throughout the territory of the Schengen member states and for the entire duration of his stay. The minimum coverage must be in the amount of 30,000 EUR.
