Death Abroad – How to Obtain a Slovak Death Certificate?

If the marriagebirth, or death of a Slovak citizen occurs abroad, this fact is registered in a special register, and you will subsequently be issued Slovak documents confirming these facts.

According to § 23 par. 1 of the Act on Registers „The birth, conclusion of marriage and death of state citizens of the Slovak Republic, which occurred in:

a) territory of a foreign state,

b) diplomatic mission of the Slovak Republic in a foreign state,

c) on a ship or in an airplane outside the territory of the Slovak Republic,

d) territory not belonging to any state, are recorded in the special register.“

Recording of death in special register

Death of Slovak citizen, which occurred in abroad, is announced to special register on form (recording of death). The application contains mainly these data:

Attachments needed for issuing a Slovak death certificate

To the application are submitted several attachments required by the office, where the registration is submitted, especially the original or verified copy of the foreign death certificate issued by the foreign registry office translated by a Slovak court translator into the Slovak language (all together bound). All documents – public documents issued in a foreign country must be provided with the relevant legalization clauses (apostille or superlegalisation).

Also is documented the identity document of the deceased (eventually copy of the birth certificate, eventually marriage certificate of the deceased).

According to § 23 par. 4 of the Act on Registers „The registration is carried out on the basis of a birth certificate, marriage certificate or death certificate issued by a foreign state, a document on the citizenship of the Slovak Republic, a record of birth, conclusion of marriage or death drawn up by a diplomatic mission or a registry office, or on the basis of another document, or other similar proof of a registry event. This way cannot replace the final decision of the court on the declaration of death.“

Foreign documents require an official translation into the Slovak language, the exception are documents / deeds issued in the Czech Republic. Official translations we will also provide to You if needed.

Death in Austria

Higher verification (i.e. apostille) is not needed on official / registry documents issued in the Austrian Republic.

Fee

Application for registration of a registry event, which occurred in a foreign country, into the special register, is according to item 17 of Act no. 145/1995 Coll. in the sum of 15 euros.

Who can apply for a Slovak death certificate?

The notification is submitted either by a survivor or an authorized person based on a verified power of attorney (the signature is verified either at a diplomatic mission abroad or at a Slovak notary office. If verified by a foreign notary, an apostille may also be required).

Into the special register will be recorded death only in case, if the deceased person was at the time of death a citizen of the Slovak Republic. According to information from the website of the Ministry of Foreign Affairs „The mentioned fact can be proven by one of the documents, which proves the citizenship of the Slovak Republic, valid as of the day of death (§ 9a par. 1 of the Act on Citizenship), i.e.

a) by a travel passport,

b) by an identity card or

c) by a certificate of citizenship of the Slovak Republic.“

If the applicant did not have one of the mentioned documents, the possibility is to apply for the issuance of a Certificate of Slovak citizenship of the deceased person as of the day of death.

What if occurs the opposite situation, that in Slovakia dies a foreigner?

If would occur the opposite situation, that in Slovakia dies a foreigner, is proceeded according to § 22 par. 1 of the Act on Registers, when „The death of a foreigner on the territory of the Slovak Republic shall after registration into the book of deaths always be notified to the diplomatic mission of the relevant foreign state in the Slovak Republic. If the foreign state does not have in the Slovak Republic a diplomatic mission, the registry office shall notify the death of the foreigner to the Ministry of Foreign Affairs of the Slovak Republic.“

How long takes the issuance of a Slovak death certificate?

The Special Register has 3 months for processing the application and issuance of a Slovak death certificate. This period, however, starts running only from the day of delivery of the application to the Special Register, which is led by the Ministry of Interior of the SR (not the day of submission of the application, which is not submitted directly to the Special Register).

According to § 23 par. 4 of the Act on Registers „The registration into the special register shall be carried out at the latest within three months from the day of delivery of the application to the special register. In justified cases this period can be extended by a maximum of three months. The applicant for registration into the special register shall be informed in writing about the extension of the period and the reasons for its extension.“

Where can I announce death abroad?

The application for the issuance of a Slovak death certificate is not submitted directly to the special register (osobitná matrika). The application is the recording of death itself and can be submitted only:

  • a) at the diplomatic mission of the Slovak Republic in a foreign state,
  • b) at the registry office, in whose territorial district the citizen of the Slovak Republic has permanent residence,
  • c) at the registry office, in whose territorial district the citizen of the Slovak Republic had last permanent residence, or
  • d) at any registry office, if the citizen of the Slovak Republic did not have permanent residence on the territory of the Slovak Republic (§ 23 par. 2 of the Act on Registers).
