Options for Foreigners to Obtain a Slovak Passport

The issuance of travel documents of the Slovak Republic is regulated by Act No. 647/2007 Coll. on travel documents and on the amendment and supplementation of certain laws (hereinafter referred to as the "Travel Documents Act"). According to § 8 par. 1 of the mentioned act, "a passport is issued to a citizen by the District Directorate of the Police Force competent according to the place of permanent or temporary residence of the citizen or the place where the citizen submits an application for the issuance of a passport." From the above, it follows that the prerequisite for the issuance of a Slovak passport is the state citizenship of the Slovak Republic (hereinafter referred to as "SR citizenship").

Foreigner’s Travel Document under the Travel Documents Act

The Travel Documents Act also allows for the issuance of a foreigner’s travel document. However, pursuant to the provision of § 13 of the Travel Documents Act, a foreigner’s travel document may only be issued to a stateless person who has been granted a permanent residence permit in the territory of the Slovak Republic or to a person who has been granted asylum in the territory of the Slovak Republic.

Foreigner’s Passport under the Foreigners’ Residence Act

Act No. 404/2011 on the residence of foreigners and on the amendment and supplementation of certain laws (hereinafter referred to as the “Foreigners’ Residence Act”) in the provision of § 74 regulates the possibilities of issuing a foreigner’s passport, which entitles a foreigner to travel outside the Slovak Republic and return to the Slovak Republic. Such a foreigner’s passport may be issued by the police department to:

  • a foreigner who has been granted supplementary protection in the territory of the Slovak Republic, provided they do not have their own valid travel document;
  • a third-country national (i.e., a country outside the European Union) who has been granted long-term residence based on supplementary protection (after having resided legally and continuously in the Slovak Republic for a period of five years immediately preceding the submission of the application), provided they do not have their own valid travel document;
  • a third-country national who has been granted permanent residence for reasons worthy of special consideration if they do not have their own valid travel document;
  • an adult who has been granted tolerated residence or supplementary protection as an unaccompanied minor for at least three years, during which they studied at a school in the territory of the Slovak Republic.

In addition to the above cases, a foreigner’s passport may also be issued to a third-country national who does not have their own valid travel document and cannot obtain one even through the diplomatic mission of the state of which they are a citizen, if they have been granted tolerated residence in the Slovak Republic, if a decision has been made on their administrative expulsion or the imposition of the penalty of expulsion, or if they were born in the territory of the Slovak Republic. In these cases, however, the foreigner’s passport only entitles the third-country national to travel outside the territory of the Slovak Republic, but not to return to the territory of the Slovak Republic.

The police department determines the validity of the foreigner’s passport for the necessary time, but no longer than one year, and the police department may extend the validity of the foreigner’s passport, even repeatedly.

If none of the above options apply to the foreigner, the option of obtaining a Slovak passport based on the acquisition of SR citizenship comes into consideration.
