Change of a Foreigner’s Passport – Biometric Passport
QUESTION
I already have a temporary residence permit in Slovakia. I am currently arranging a biometric travel passport in Ukraine. Once I have it, do I have to report it to the police? It is a biometric passport, and I will then have two passports.
ANSWER:
The duties of a third-country national in the area of residence are listed in Section 111 of the Act on the Residence of Foreigners. Among others, the subject provision states the duty to “report to the police department a change of name, surname, personal status, citizenship, data in the travel document within five working days from the day the change occurred, and the replacement of the travel document.”
The law establishes the duty to report the replacement of a travel document or a change in the data contained therein. It does not state a duty to report the issuance of a new (second) passport in the event that the “original” passport is valid and no changes to the data contained therein have occurred.
Notwithstanding the above, we recommend inquiring with the foreign police as to whether they require notification of a second travel document and proceeding according to their instructions.
