According to Act No. 404/2011 Coll. on the Residence of Foreigners, as amended, a citizen of another EU Member State may reside in the territory of the Slovak Republic for three (3) months without any registration.
A citizen of another EU Member State may reside in Slovakia for more than three (3) months in the cases specified by law (Section 65 of the Act on the Residence of Foreigners), specifically if they:
-
are employed in the territory of the Slovak Republic;
-
are self-employed in the territory of the Slovak Republic;
-
have sufficient resources for themselves and their family members so that they do not become a burden on the material need assistance system of the Slovak Republic during their period of residence, and have health insurance in the territory of the Slovak Republic;
-
are studying at a primary school, secondary school, or university in the Slovak Republic;
-
are presumed to become employed; or
-
are a family member of an EU citizen whom they accompany or join and who meets the conditions for residence according to one of the points above.
If a citizen of another EU Member State resides here for longer than three (3) months, they are obliged to apply for registration of residence in the territory of the Slovak Republic. Pursuant to Act No. 580/2004 Coll. on Health Insurance, as amended, a person insured in another EU Member State has the right to reimbursement of the costs of healthcare provided in the Slovak Republic that falls within the scope of healthcare covered by public health insurance in the Slovak Republic according to special regulations, namely:
-
necessary healthcare;
-
full-range healthcare, if the person insured in another Member State has their residence in the Slovak Republic;
-
healthcare with the consent of the competent institution of another Member State.
Necessary healthcare in relation to a person insured in another Member State is healthcare required by the insured person’s state of health, which must be provided considering the nature of the healthcare and the expected length of the stay in the Slovak Republic so that the person does not have to return to the state of insurance for necessary treatment earlier than originally intended. The scope of necessary healthcare is determined by the attending physician.
Full-range healthcare in relation to a person insured in another Member State, if they have their residence in the Slovak Republic, is healthcare that falls within the scope of healthcare covered by public health insurance in the Slovak Republic.
Healthcare with the consent of the competent institution of another Member State is healthcare aimed at treating an already existing health problem of the insured person, approved by the competent institution of the other Member State; its provision, date, and location must be agreed upon in advance by the insured person with the healthcare provider.
The above follows from Section 9c of Act No. 580/2004 Coll. on Health Insurance: “(1) A person insured in another Member State has the right to reimbursement of the costs of healthcare provided in the Slovak Republic that falls within the scope of healthcare covered by public health insurance in the Slovak Republic according to special regulations, namely: a) necessary healthcare, b) full-range healthcare, if the person insured in another Member State has their residence in the Slovak Republic, c) healthcare with the consent of the competent institution of another Member State. (2) Necessary healthcare in relation to a person insured in another Member State is healthcare required by the insured person’s state of health, which must be provided considering the nature of the healthcare and the expected length of the stay… so that they do not have to return to the state of insurance… earlier than originally intended. The scope of necessary healthcare is determined by the attending physician. (3) Full-range healthcare… if the person insured in another Member State has their residence in the Slovak Republic, is healthcare that falls within the scope of healthcare covered by public health insurance in the Slovak Republic. (4) Healthcare with the consent of the competent institution of another Member State… is healthcare aimed at treating an already existing health problem… approved by the competent institution of the other Member State; its provision, date, and location must be agreed upon in advance by the insured person with the healthcare provider.
