A third-country national is entitled to be granted permanent residence for an unlimited period if there are no grounds for rejecting his or her application by the Foreigners’ Police Department (OCP) and if he or she has held permanent residence for five years for a period of at least four years. We may conclude that this represents a form of “renewal” of residence, since the third-country national, instead of applying for another five-year residence permit, is entitled to apply directly for permanent residence for an unlimited period.

Who can apply for permanent residence for an unlimited period?

A foreign national may apply for permanent residence for an unlimited period if:

  • a) they have held permanent residence for 5 years under § 43 for at least four years, or
  • b) they are a child under 18 years of age of a third-country national with permanent residence for an unlimited period, or a child under 18 years of age entrusted to the personal care of a third-country national with permanent residence for an unlimited period.

It is also required that there are no grounds for rejecting the application for permanent residence under § 48 para. 2 of the Act on the Residence of Foreigners (e.g. the third-country national is considered an undesirable person, there is a reasonable suspicion that their stay would endanger state security, public order or public health, they do not meet the residence requirements, they have entered into a marriage of convenience, they provide false or misleading information, or submit forged or altered documents or documents of another person, or the data in their travel document does not correspond to reality).

The five-year permanent residence granted to a foreign national is considered valid in the territory of the Slovak Republic until a decision is made on the application for permanent residence for an unlimited period.

Termination of Permanent Residence

Permanent residence shall terminate if:

  • the third-country national does not enter the territory of the Slovak Republic within 180 days from the granting of permanent residence,
  • the third-country national notifies in writing the police department of the termination of residence,
  • the validity of the third-country national’s granted permanent residence under § 43 has expired and he or she has not applied for permanent residence under § 46,
  • the third-country national has been sentenced to expulsion,
  • the third-country national has been administratively expelled,
  • the third-country national has acquired Slovak citizenship,
  • the police department has revoked the permanent residence of the third-country national,
  • the third-country national has obtained a different type of residence under this Act than the one previously held, or has been granted asylum, or
  • the third-country national has died or been declared dead.
