We have previously informed you regarding the standard procedure and the statutory prerequisites for submitting an application for the granting of a temporary residence permit for the purpose of family reunification in respect of a spouse or children in our article: Temporary Residence of a Third-Country National within the Territory of the Slovak Republic for the Purpose of Business. This article shall focus on the granting of temporary residence to the parent/parents of an alien, or, as the case may be, the parents of their spouse. It is, however, a statutory condition precedent that the alien or their spouse already holds a temporary residence permit or submits an application for the granting of temporary residence concurrently with the parent.

Residence for the parent of an alien / the parent of an alien’s spouse
In certain instances, however, an alien may also intend to apply for a temporary residence permit in respect of their parent or, as the case may be, the parent of their spouse. Pursuant to Act No. 404/2011 Coll. on the Residence of Aliens, as amended, an application for family reunification may be submitted by a family member of a third-country national who holds a temporary residence permit or a permanent residence permit within the territory of the Slovak Republic.
In this context, a parent of a third-country national or a parent of their spouse shall be deemed a family member of the third-country national, provided that such parent is dependent on the care of the third-country national and does not enjoy proper family support in the country of origin. The aforementioned circumstances must be duly demonstrated by:
- a vital statistics document of the alien or, as the case may be, of their spouse – which shall demonstrate compliance with the condition of a family relationship between the alien / their spouse and the parent
- a medical certificate confirming the parent’s dependency on the care of their child
- an affidavit demonstrating that the parent does not enjoy proper family support in the country of origin
The remaining supporting documents are identical to those required when submitting an application for the granting of a residence permit for the purpose of family reunification, for instance in respect of a spouse; meaning that it is also necessary to submit the following:
- a valid travel document
- two photographs measuring 3 x 3.5 cm showing the current appearance
- an administrative fee stamp
- a criminal record clearance certificate issued by the country of origin, as well as by any country where the individual has resided for more than 90 days during the last 6 months within the consecutive three years retrospectively
- proof of accommodation
- proof of financial competence
Provided that the alien resides within the territory of the Slovak Republic lawfully (e.g., within the visa-free period), the application may be submitted in Slovakia (please note, however, that a tourist visa cannot be utilized for the purpose of submitting a residence permit application). The statutory period for the police department to issue a decision is 90 days.
