Business Visa for an Indian Citizen

Since India is not among the countries with which the Slovak Republic maintains a visa-free regime, the granting of a visa is required even in the event of a short-term business or work visit of an Indian citizen to business partners within the territory of the Slovak Republic lasting a few days. In the following article, we will outline the procedure for obtaining a visa in the aforementioned case.

Schengen Visa

The legal order allows for the granting of a Schengen visa or a national visa. Pursuant to Section 15 of Act No. 404/2011 Coll. on Residence of Aliens and on Amendments to Certain Acts (hereinafter referred to as the “Act on Residence of Aliens”), a national visa may be granted provided that (i) the national visa is necessary in connection with the granting of residence in the Slovak Republic, (ii) the applicant is older than 15 years of age and has been accepted for language education at a language school with a minimum workload of 25 teaching hours per week, (iii) the granting of the visa is necessary for the fulfillment of the commitments of the Slovak Republic arising from international treaties, or (iv) the granting of the visa is in the interest of the Slovak Republic.

For the purpose of a business or work trip, it is therefore possible to apply for the granting of a Schengen visa.

Application for Verification of an Invitation

The first step is the submission of an application for verification of an invitation by the inviting person to the competent Foreign Police Department according to the place of residence or registered office of the inviting person. The inviting person may be a natural person – a citizen of the Slovak Republic or a foreign national with lawful residence within the territory of the Slovak Republic (excluding tolerated residence) – or a legal entity with its registered office in the Slovak Republic.

The application for verification of an invitation shall be submitted on the prescribed form. A sample form is accessible here. The form also includes an undertaking by the inviting person to cover all costs associated with the residence and departure of the invited foreign national.

The application for verification of an invitation must be submitted in person at the competent Foreign Police Department – either by the inviting person (in the case of a legal entity, by its statutory representative) or by an authorized proxy.

In the case of a business visit, the attachments to the application for verification of an invitation shall include documents, not older than 90 days, demonstrating:

  • purpose of the invitation (a document proving the inviting person’s authorization to conduct business – e.g., an extract from the Commercial Register usable for legal acts and an invitation letter in which the inviter describes in detail the reasons for the business partner’s arrival, the nature of the business cooperation the visit concerns, which locations the foreign national will visit and whom they will meet, why their presence within the territory of the Slovak Republic is necessary, and similar details)
  • ability of the inviter to cover the costs associated with the stay and departure of the invited person (a bank statement certifying the account balance of the inviter, provided that the balance amount must equal at least 12 times the subsistence minimum plus financial resources in the amount of EUR 56 for each day of the invited foreign national’s stay – thus amounting to EUR 7,433.76 in the case of the maximum 90-day duration of stay)
  • provision of accommodation for the invited person (a confirmation from an accommodation facility or a consent of the property owner with an officially certified signature)

Verification of an Invitation

The invitation shall be verified by the competent Foreign Police Department of the Police Force following the prior consent of the Ministry of Interior of the Slovak Republic within a period of 15 days from the receipt of the application for verification of the invitation. The Ministry of Interior shall also determine the duration of stay in the verified invitation. The duration of stay is determined according to the time required to fulfill the purpose of stay, provided that the maximum duration of stay is 90 days. A verified invitation is valid for 90 days.

Tip

Practical Tip: At the outset of the process for granting a visa to a citizen of India, we recommend contacting the competent diplomatic mission and inquiring whether they will require an invitation letter verified by the Foreign Police. Verification of an invitation is not required in certain cases (for instance, in practice we have encountered a case where the foreign national had already undertaken a business visit to a major Slovak company with which they cooperate).

Submission of a Visa Application

Following the verification of the invitation, an application for the granting of a Schengen visa may be submitted. In the case of an Indian citizen, the submission of an application for the granting of a Schengen visa to enter the Slovak Republic is possible at any of the three visa application centers with which the Slovak Republic has concluded a contract. These are the visa centers in Delhi, Mumbai, and Bengaluru. The submission of the application is possible on any working day during business hours, even without a prior appointment.

The application, together with its supporting documents submitted at the visa center, is subsequently forwarded for processing to the Slovak consular post in Delhi.

Please note that the application must be submitted in person by the invited foreign national and cannot be submitted by proxy. Although the use of services provided by so-called visa agents is common in India, based on our experience we do not recommend using such services.

Application for the Granting of a Visa

The application for the granting of a Schengen visa shall be submitted on the prescribed form, a sample of which is accessible here.

The attachments to the visa application are:

  • a recent color photograph with dimensions of 3 x 3.5 cm
  • a document confirming the purpose of stay (an invitation letter together with the verification of the invitation letter)
  • a confirmation of accommodation provision
  • a confirmation of travel insurance coverage
  • financial resources for the stay
  • provision of means of departure (e.g., a return ticket)
  • a valid travel document shall also be presented
