Are you a foreigner with a residency permit in Slovakia and you are unsure if your stay is still valid? In practice, we often encounter cases where foreigners rely solely on the date printed on their plastic card (residency document). The reality, however, is that the validity of your residency may not match the date on the document.

Why the date on the card may not be decisive?

Many foreigners are unaware that their temporary or permanent residency can expire earlier or, conversely, be automatically extended by law.

  • Administrative Restrictions: A residency document is often issued only for the duration of your documented proof of accommodation or is limited by the validity of your passport. This does not necessarily mean that the underlying right to reside expires on the same day.
  • Statutory Extension during the Emergency Situation: Specific rules currently apply in Slovakia due to the armed conflict in Ukraine. According to current legislation:“The validity of temporary residence, permanent residence, or tolerated residence, which would otherwise expire during the emergency situation declared in connection with the mass influx of foreigners to the territory of the Slovak Republic caused by the armed conflict in the territory of Ukraine (hereinafter referred to as the ’emergency situation’), is extended until the expiration of two months from the revocation of the emergency situation; this does not apply to a third-country national whose application for renewal of temporary residence has been rejected.”
  • Revocation of Residency by Law: The police may revoke a foreigner’s residency for statutory reasons. If a foreigner does not collect their mail at the registered address, they may not even be aware that their residency has ended.
