Which documents are needed when I want as EU citizen to register my residency in Slovakia?

Below are the details regarding the registration of residence for an EU citizen. The following documents are required for registering the residence of an EU citizen:

  • Application – The system will automatically generate it after reserving a date for submitting the application.
  • Original valid passport
  • Cash in the amount of at least the minimum living wage, i.e., 273.99 euros – The cash is shown to the police officer at the time of application submission.
  • Proof of health insurance or a European Health Insurance Card.
  • Notarized declaration of accommodation with an officially verified signature.
  • Color photograph showing the current likeness of the face in dimensions 3 x 3.5 cm.

Greetings, my acquaintance is an EU citizen and I want to ask if they have any obligations when they enter the territory of the SR?

ANSWER:

Hello, In the sense of the Act on the Residence of Foreigners, a Union citizen is:

  • a citizen of another EU member state except for the Slovak Republic,

  • a citizen of a state that is a contracting party to the Agreement on the European Economic Area (EEA), and

  • a citizen of Switzerland.

This EU citizen has the obligation, within 10 days from the date of entry into the territory of the SR, to report the start and place of their residence to the foreign police according to the place of residence via the relevant form, which is available on this website – https://www.minv.sk/?hlasenie-pobytu-1 .

An EU citizen who stays in Slovakia for longer than three months is obliged to apply for residence registration within 30 days of the expiration of three months from the date of entry into the territory of the Slovak Republic. The application for free residence registration is submitted on an official form (generated for you by the reservation system) in person at the relevant department of the foreign police.

Hello,
I want to register my residence as an EU citizen. How long will I wait for the decision?

ANSWER:

On the day when a complete application for residence registration is submitted, the police department shall issue a confirmation of registration.

In the event that you are interested in or need a residence card (residence document) and the confirmation of registration alone is not sufficient for you, it will be necessary to attach a proof of accommodation to the application.

The issuance period of the residence card depends on the fee you pay: – 10 EUR, if the document is issued and delivered within 30 days, – 39 EUR, if it is issued and delivered within 2 working days.

QUESTION

Hello,
before Brexit, I had a registered residence of a European Union citizen in Slovakia; however, I did not exchange my residence card (issued for 5 years) by June 30, 2021. Can I continue to stay in Slovakia? What are my obligations according to the current legislation?

ANSWER:

In connection with Brexit, specific changes and adjustments concerning the residence of United Kingdom citizens in the Slovak Republic have occurred: According to Section 131j, Paragraph 2 of the Act on the Residence of Foreigners: “The residence of a United Kingdom national or their family member under Section 2, Paragraph 5, who had the right of residence under Section 65 or Section 70 before January 1, 2021, and demonstrates the exercise of this right in a credible manner, is considered permanent residence for five years.” Based on the above, your residence was converted from an EU citizen registration to a permanent residence for five years. In conjunction with Section 131j, Paragraph 6 of the Act on the Residence of Foreigners: “Upon request, the police department shall issue a residence document with a validity of ten years to a United Kingdom national or their family member under Paragraph 1 within 30 days. Upon request, the police department shall issue a residence document with a validity of five years to a United Kingdom national or their family member under Paragraphs 2 to 5 within 30 days.”

In the sense of the stated provisions, the change in the type of residence occurs automatically by operation of law.

Regarding the EU citizen residence card:

  • The validity of the residence card of an EU citizen issued to a United Kingdom national, and the residence card of a family member of an EU citizen issued to their family member under Section 2, Paragraph 5 until December 31, 2020, ends on the date of expiration stated therein, no later than June 30, 2021.

  • The United Kingdom national and their family member under Paragraphs 1 to 3 are obliged to apply for a new residence document by June 30, 2021.

We point to the explanatory memorandum to Act No. 424/2020 Coll., which supplements Act No. 404/2011 Coll. on the Residence of Foreigners and on amendments and supplements to certain acts as amended: “The Slovak Republic has decided on a declaratory system, which means that for United Kingdom citizens and their family members who exercised the right to free movement before January 1, 2021, and registered their residence at the relevant foreign police department, the right to residence follows directly from the law without the need for further decision-making. Their only obligation is to apply for the issuance of a residence document by June 30, 2021.”

I would like to ask whether the law stipulates a mandatory duration of health insurance when applying for the registration of residence of an EU citizen?

According to the statement of the foreign police OCP PZ Nitra: “the law does not stipulate a mandatory duration of insurance for EEA nationals.” (OCP PZ Nitra)
