Temporary Residence for the Purpose of a Special Activity – for Athletes and Coaches

Temporary Residence in the Territory of the Slovak Republic may be granted to a foreign national pursuant to Act No. 404/2011 Coll. on the Residence of Foreigners and on Amendments and Supplements to Certain Acts (hereinafter referred to as the “Act on the Residence of Foreigners”) only for a specific purpose. Among the most common purposes are, for example, employment, which we have already discussed in previous articles. However, the purpose of employment does not apply to every activity that bears the characteristics of dependent work which a foreign national might perform in Slovakia. For certain so-called special activities (e.g. coaches, athletes, and similar professions), the Act on the Residence of Foreigners establishes a distinct category of residence purpose. In such cases, this is referred to as temporary residence for the purpose of a special activity. This article provides a closer look at this type of temporary residence, particularly in relation to a sports coach.

For What Activities Can Temporary Residence for the Purpose of a Special Activity Be Granted?

Pursuant to Section 25 of the Act on the Residence of Foreigners, temporary residence for the purpose of a special activity may be granted to a foreign national who is not engaged in business for the following types of activities:

  • Lecturing activity
  • Artistic activity
  • Sports activity
  • Internship within higher education studies or within two years after completing higher education (in the case of students who are studying, or who have studied within the two-year period, at a university outside the territory of the Slovak Republic)
  • Activity resulting from programs of the Government of the Slovak Republic or of the European Union
  • Fulfilment of obligations of the Slovak Republic arising from an international treaty
  • Provision of healthcare or accompanying a third-country national who is receiving healthcare (if necessary)
  • Voluntary (volunteer) activity
  • Activity of a journalist accredited in the Slovak Republic

What Is Considered a Sports Activity?

The definition of the term “sports activity” is not contained in the Act on the Residence of Foreigners, but rather in a separate act – Act No. 440/2015 Coll. on Sport and on Amendments and Supplements to Certain Acts (hereinafter referred to as the “Act on Sport”).

According to Section 3(a) of the Act on Sport, a sports activity is defined as:

“the performance, organization, management, administration, support, or development of sport.”

Sports Coach

The Act on Sport also defines who may be regarded, for the purposes of the Act, as an athlete and who as a sports professional. Pursuant to Section 6(1)(a) of the Act on Sport, a sports professional includes a coach and a sports instructor. In general, a sports professional may perform their activity as a business, under a contract for the performance of a sports professional’s activity, under an employment or similar contractual relationship, as a volunteer, or even without a contract.

However, in the case of a foreign national applying for temporary residence for the purpose of a special activity, it is also necessary to consider the provisions of the Act on the Residence of Foreigners and the Act on Employment Services, meaning that not all of the above options may be applied. An appropriate option in such cases is the performance of the activity based on a contract for the performance of a sports professional’s activity.

Under a contract for the performance of a sports professional’s activity, the sports professional undertakes to perform, for a sports organization, the activities of a sports professional for remuneration, for a maximum of 30 hours per week.

The sports organization is required to conclude this contract in writing. The contract must specify the type of sports activity, the amount of remuneration, and the duration for which it is concluded. The sports organization must provide the sports professional with one copy of the signed contract.

The contract for the performance of a sports professional’s activity is concluded for a fixed period, not exceeding 12 months. Such a contract may be concluded repeatedly.

Application for Temporary Residence

An application for temporary residence must be submitted in person using the officially prescribed form.

Attachments to the Application for Temporary Residence

When submitting an application for the granting of temporary residence, it is necessary to provide documents not older than 90 days, including:

  • A document proving the purpose of stay – such as a contract for the professional performance of sports activities, or a confirmation issued by a sports organization or the relevant state authority.
  • An extract from the criminal record.
  • A document proving financial security – for example, a bank statement or confirmation of account balance in the name of the third-country national.
  • A document proving accommodation arrangements.

Granting of Temporary Residence

If the statutory conditions are met, the police department shall grant the foreign national temporary residence for the anticipated duration of the contract for the professional performance of sports activities, but for no longer than five years.

Temporary residence for the purpose of a special activity is not required for up to 90 days from the beginning of the stay in the territory of the Slovak Republic, provided that the third-country national meets the conditions of stay under the Schengen Borders Code and has fulfilled the obligation to report their place of residence within three working days of arrival in the Slovak Republic (unless this has already been carried out by the accommodation provider).

Social Insurance

As of 1 January 2022, a professional athlete performing activities under a contract for the professional performance of sports activities pursuant to a special regulation (Act No. 440/2015 Coll.) is regarded as an employee for the purposes of the Act on Social Insurance.
Accordingly, the athlete is subject to mandatory social insurance in full scope.
