Temporary Residence for the Purpose of Family Reunification

• A valid travel document.

• A document confirming the purpose of residence, usually a marriage certificate.

• A criminal record extract from the applicant’s country of origin and from any countries where the applicant has resided for more than 90 days within the last three consecutive years; generally not older than 90 days.

• If the applicant is the owner of an apartment or other real estate in the territory of the Slovak Republic, an extract from the Land Register (a printout from the online register is sufficient). If the property is owned solely by the spouse, the spouse must also submit a statutory declaration confirming that accommodation will be provided to the applicant for the entire duration of residence in the Slovak Republic or for an indefinite period.

• If the applicant is renting accommodation, either a lease agreement with notarized signatures of all property owners and the foreign national must be submitted, or a statutory declaration of the property owners confirming the provision of accommodation.

• Administrative fee.

In certain cases, additional documents must be provided; this always depends on the individual situation. The following is a summary of all required documents, including possible alternatives.

Documents required for submitting an application for the granting of temporary residence for the purpose of family reunification under Section 27 of the Act on the Residence of Foreigners:

1. A valid travel document (pursuant to Section 2(1)(k) or Section 125(3) of the Act on the Residence of Foreigners).

Document not older than 90 days confirming the purpose of residence (Section 32(2)(a) of the Act on the Residence of Foreigners):

• Civil status document (marriage certificate, child’s birth certificate) – may be older than 90 days:

  1. Statutory declaration of the legal guardian confirming that the child is unmarried,

  2. Copy of the residence permits of the child’s parents,

  3. Copy of the residence permit of the guarantor,

  4. Copy of the decision of the competent authority granting custody of the child,

  5. Document proving a long-term adverse health condition,

  6. Document proving dependency (for example, a medical report stating that the third-country national’s health condition requires the care of another person, and a statutory declaration confirming that the person does not have adequate family support in the country of origin) – (Section 32(5)(n) of the Act on the Residence of Foreigners).

Document not older than 90 days confirming consent (Section 32(2)(f) of the Act on the Residence of Foreigners):

1. Consent confirming that, in the case of a third-country national who is an unmarried child under 18 years of age and an unmarried child of his or her spouse under 18 years of age, the parent who has not been granted custody and who has the right to maintain contact with the child consents to the family reunification (Section 27(4) of the Act on the Residence of Foreigners).

Document not older than 90 days confirming integrity (Section 32(2)(b) of the Act on the Residence of Foreigners):

1. Extract from the criminal register of the country of which the applicant is a national,

2. Extract from the criminal register of any country in which the third-country national has resided for more than 90 days during the last three consecutive years.

Document not older than 90 days confirming accommodation (Section 32(2)(e) of the Act on the Residence of Foreigners):

1. Title deed or extract from the Land Register issued in the name of the third-country national,

2. Notarized lease agreement with the owner or lawful user of the property and an extract from the Land Register or another document proving the right to use the property (for example, an allocation document for the apartment),

3. Confirmation from the accommodation facility providing accommodation (for example, confirmation from a hotel or hostel),

4. Notarized statutory declaration of a natural or legal person confirming the provision of accommodation to the third-country national, together with an extract from the Land Register or another document proving the right to use the property, or

5. Hosting agreement, if it also includes the provision of accommodation (Section 122 of the Act on the Residence of Foreigners).
