Temporary residence in the territory of the Slovak Republic may be granted to a foreigner under Act No. 404/2011 Coll. on the Residence of Foreigners and on amendments to certain acts (hereinafter referred to as the “Act on the Residence of Foreigners”) only for a specific purpose. For which activities can residence for the purpose of special activity be granted?
A police department shall grant temporary residence for the purpose of special activity, provided there are no grounds for refusing the application, to a third-country national who is not an entrepreneur, for:
- Lecturing activities.
- Artistic activities.
- Sporting activities.
- Internships within higher education studies outside the territory of the Slovak Republic, or up to two years after graduation from higher education outside the territory of the Slovak Republic.
- Activities resulting from Slovak government programs or European Union programs.
- Fulfillment of a commitment of the Slovak Republic arising from an international treaty.
- Provision of healthcare or accompanying a third-country national receiving healthcare, if necessary.
- Volunteering activities.
- Activities of a journalist accredited in the Slovak Republic.
The police department shall grant temporary residence for the purpose of special activity for the time necessary to achieve its purpose, but for a maximum of two years. In the case of temporary residence for special sporting activity, the police department shall grant temporary residence for the expected duration of the professional sports contract, but for a maximum of five years.
Temporary residence for the purpose of special activity is not required for up to 90 days from the beginning of stay in the territory of the Slovak Republic if the third-country national meets the conditions for stay under the Schengen Borders Code and reports the start, place, and expected duration of the stay to the police department within three working days of entry, provided they have a Schengen visa, a national visa, or are visa-exempt (unless this obligation falls on the accommodation provider).
Application for Temporary Residence
A third-country national shall attach a valid passport to the application for temporary residence and documents not older than 90 days confirming:
1. Purpose of stay (proven based on the specific activity):
- Lecturing: Confirmation from a school or other educational institution.
- Artistic: Confirmation from a state administration body or an arts agency.
- Sporting: A contract for professional sports performance, confirmation from a sports organization, or a relevant state body.
- Internship: An internship certificate including the training program description, educational goal, duration, placement/supervision conditions, working hours, and the legal relationship between the intern and the host organization.
- Government/EU programs: Confirmation from the relevant state administration body or the organization managing such a program.
- Healthcare: Confirmation from a medical facility or a document proving the need for an escort.
2. Integrity (Criminal Record) Third-country nationals prove integrity with an extract from the criminal record of the state of their nationality and the state where they resided for more than 90 days during six consecutive months in the last three years.
3. Accommodation The document proving accommodation must show that the third-country national has secured housing for at least six months of the temporary residence; if the residence is shorter, it must cover the entire duration.
Granting of Temporary Residence
The police department shall decide on the application within 30 days of receiving a complete application. If the application is approved, no formal written decision is issued; instead, a notification (paper or electronic) is sent to the third-country national stating the date of granting and the expiration date of the residence.
Grounds for Refusal
The application shall be refused if:
- The applicant for volunteering is younger than 15 years old.
- The person is an undesirable person or a threat to state security, public order, or public health.
- The person does not meet the conditions for granting residence or has entered into a marriage of convenience.
- False or misleading information or forged documents were provided.
- Granting the residence is not in the public interest or the accommodation does not meet minimum requirements.
Expiration of Temporary Residence
Residence expires if:
- The foreigner does not enter the Slovak Republic within 180 days of being granted residence.
- The foreigner reports the end of their stay or the residence validity expires.
- The foreigner is deported, acquires Slovak citizenship, or dies.
