This type of temporary residence is intended for applicants who already hold long-term residence in another European Union Member State and who, at the same time, carry out an activity in Slovakia that would, by itself, constitute grounds for granting temporary residence (e.g., business activities, employment, or another specific activity). Holding long-term residence in another EU Member State significantly simplifies and streamlines the process of obtaining temporary residence in Slovakia.
Who is eligible for the granting of temporary residence?
Temporary residence shall be granted by the police department to a third-country national who has been granted long-term resident status in another Member State, provided that there are no grounds for refusing the application and that he or she:
- conducts business activities in the territory of the Slovak Republic,
- is employed in the territory of the Slovak Republic,
- studies at a school in the Slovak Republic,
- performs an activity referred to in Section 25 (Temporary residence for the purpose of special activity) or Section 26 (Temporary residence for the purpose of research and development), or
- is a family member under Section 27(2) of a third-country national referred to in points (a) to (d), and the family already existed in the other Member State that granted the third-country national long-term resident status.
A third-country national may simultaneously carry out more than one of the above-mentioned activities.
Tip
Temporary residence is not required for up to 90 days from the beginning of the stay in the territory of the Slovak Republic, provided that the third-country national meets the conditions for residence under the Schengen Borders Code and has fulfilled the obligation to report their stay.
Application for the granting of temporary residence
A third-country national who has been granted long-term resident status in another Member State is required to submit the following documents with the application for temporary residence in the territory of the Slovak Republic:
- a valid travel document,
- the purpose of residence, which consists of the long-term residence permit issued under a special regulation by the Member State and an employment contract, or another document pursuant to Section 32(5)(a), by submitting a business plan, the template of which is published on the website of the Ministry of Economy of the Slovak Republic, and a document demonstrating the feasibility and sustainability of the business activity or business plan aimed at implementing an innovative project,
- proof of accommodation:
- a statutory declaration of the foreigner regarding ownership of real estate,
- a lease agreement with the owner of the property and a document proving the right to use the property,
- a confirmation from an accommodation facility on the provision of accommodation, or
- a statutory declaration of a natural or legal person on the provision of accommodation to the foreigner in the territory of the Slovak Republic, along with a document proving the right to use the property if the statutory declaration is submitted by the user of the property,
- administrative fee.
Duration of temporary residence
The police department shall grant temporary residence for the period necessary to achieve its purpose, but for no longer than five years.
